Ye sawal ke TAQLEED kya hai? Isko Fanni aetebar se samajhne ke liye bhot ziada tag o do(mehnat) karne ki zaroorat nahi hoti ye bhot hi saadah si baat hai jisko Saleemul fitrat aur Saheeh Aqal ka haamil insan bhot Aasani se samajh sakta hai:
Jo Masla Quran o Hadees me mazkoor nahi hai uska hukum Quran o Hadees me bayan kardah Usool aur Ahkaam ko samne rakh kar nikaalne ka naam IJTEHAAD hai, jis Muhaqqiq Aalim me ye Ijtehaad ki salaahiyat hoti hai usko MUJTAHID kehte hain aur jis me ye salahiyat nahi hoti usko Laaziman aise Mujtahid Aalim se Masla maloom karna hai, aur uski pairwi karna hai , Bus yahi – aise Masail me kisi Mujtahid ki pairwi karna – TAQLEED hai aur aisa karne wala MUQALLID hai.
Isi me ye Soorat bhi daakhil hai ke Quran ya Hadees me koi Masla bazaahir Muta’aariz nazar aaraha hai, is Ta’aaruz ko khatm kar ke kis Soorat par Amal karna hai AAM AADMI iska andaza nahi laga sakta, MUJTAHID apne Ijtehaad se us Ta’aaruz ko khatm kar ke Raajeh SOORAT maloom karta hai aur Aam Aadmi us se Maloom kar ke Amal karta hai aur uski pairwi karta hai, Bus Yahi TAQLEED hai.
Dalail ki tafseel maloom hona ya na hona TAQLEED ke zaili umoor me se hain, jis Shakhs ko IJTEHAAD ki salahiyat haasil nahi hai wo Mujtahid ke Dalail ka Tatabbo to karsakta hai lekin uska Ihaata karlena uske bus ki cheez nahi hai, balke bhot si sooraton me aur Bhot se logon ke liye samjhane ke bawajood Dalail ka samajhna Mumkin hi nahi hota.
Ab 2 hi baaten hain : Ya to Koi Mujtahid ho, agar koi Mujtahi nahi hai to wo Muqallid baney, teesri koi aur Soorat Mumkin nahi hai

“Imam Shafai ne unke FATAWA ke Khilaf SAHEEH HADIS milne par HADIS par AMAL ki WASIYYAT farmai hai, iska Ye Matlab nahi ke koi bhi Shaqs kisi SAHEEH HADIS ko dekh kar use IMAM SHAFAI ka Mazhab qarar de aur uske Zaahir par Amal kare, balke uska HAQ usi ko hai jo (ILMI SALAHIAT me Kamaal ki wajeh se) IJTIHAD FIL MAZHAB ke Rutbe tak ya uske Qareeb pohanch chuka ho. Neez ye bhi SHART hai ke uska Ghalib gumaan ye ho ke IMAM SHAFAI ko us HADIS ka ya uski SEHAT ka ILM na tha, aur ye baat IMAM SHAFAI ki tamam kitaben aur unke Shagerdo ki KITABO ke Mutalae(padhne) ke baad hi hasil hogi aur ye Shart kaafi Mushkil hai aur Kam hi Koi in Sharait se Muttasif hoga, ULAMA ne ye Shart islye lagai hai ke IMAM SHAFAI ne kaafi RIWAYAAT se waqfiat ke bawajood unke Zaahir par Amal ko tark kiya(chod dya), kyu ke unki TEHQEEQ me usme koi TA’N, NASKH, TAKHSEES YA TAWEEL wagaira ka SABOOT tha (jiski wajeh se us zahir par Amal Durust na tha.)”

“SAHABA IKRAAM(RAZI ALLAHU ANHUM) aur Quroone Oola ke Akabir Agarche DARJE ke AETEBAR se Baad ke FUQAHAE MUJTAHIDEEN se BULAND O BARTAR hain,
Lekin unhe itna MAUQA nahi mila ke Wo apne ILM aur uske USOOL O FUROO’ ko Mudawwan aur Munzabit kar sakte, islye kisi shaqs ke lye unke FIQHI MAZHAB ki TAQLEED jayaz nahi, kyu ke un me se kisi ka MAZHAB MUDAWWAN nahi hosaka, na wo Likhi hui SHAKAL me Maujood hai aur na Mutayyan taur se uski NISHANDAHI ki jasakti hai,
Darasal Tadweene Fiqh ka ye kaam Baad ke AIMMA ne kiya hai,
Jo Khud SAHABA O TABAEEN ke Mazahib ke Khausha Cheen(FAIZ HASIL KARNE WALE) the aur jinho ne WAQIAAT ke pesh aane se pehle hi unke EHKAAM mudawwan kiye aur Apne MAZAAHIB ke Usool o FIROO’ ko Wazeh kiya Maslan Imam Malik(RAH) aur Imam Abu Hanifa(RAH).”
