Dono Tareefon Ka Haasil Yahi Hai Keh Mujtahid Ke Qaul O Fael Ko Maloom Kar Ke Mahez Husn E Zann Aur Aqeedat Ki Binaa Par Tasleem AurAmal Kare, Aur Tasleem O Amal Ke Waqt Mujtahid Ki Daleel Ki Fikr Na Kare Aur Na Is Se Daleel Talab Kare Khwah Baad Me Wahi Daleel Maloom Hojaye Jo Mujtahid Ke Pesh E Nazar Thi Ya Apne Mutalaee Aur Tehqeeq Se Us Masle Ke Bhot Se Dalail Maloom Hojayen To Ye Maloom Hojana Taqleed Ke Khilaf Nahi Hai. HUQUB WALI HADEES KA JAWAB

Assalamu alaikum.

Ghair Muqallideen me aksar aise naujawaan hote hain jinhe Ilm to kuch nahi rehta bus un ka kaam ye hota hai ke Fazael e Aamaal ke khilaf kuch na kuch kaha jaye. Aur apne Ulama (!?) ki jo bhi baat Fazael e Aamaal ke Khilaf ho use baghair tehqeeq ke naqal kardete hain agar che unke Ulama bhi itne jaahil hain ke Unhe Khud Usool e Hadees se waqfiyat nahi hoti hai ya agar hoti hai to Fazael e Aamaal se bughz ki wajeh se Kitmaan e ilm karte hain.

Usool e Hadees ka ek Qaida hai jo Ap ko Usool e Hadees ki kitabon me mil jayega wo ye ke Jab Zaeef Riwayat baghair sanad ke Riwayat karna ho to wahan قال رسول الله صلي الله عليه وسلم nahi kehna chahye balke ek segha e Tamreez istemal karna chahye jaise رُوِيَ عَنْهُwaghaira.

Is par aetraz ye hota hai ke Jhooti hadees Shaikhul Hadees ne bayan ki hai aur us ki sanad chupai hai waghaira waghaira. (naoozu billah)

Motariz ko asal me Usool e Hadees ka ilm nahi hai isliye wo aisi baat keh rahe hain.

Usool hum ne oopar bata diya hai ke Jis Zaeef Hadees ko Sanad ke baghair Riwayat karna ho usko Seghe Tamreez se Riwayat kiya jaye aur Shaikhul Hadees Rahmatullahi alaih ne diyanat ke sath kaam lete hue

(1) Hadees ko Seghae Tamreez se Riwayat kiya hai

(2) Aur Us par tamam bahes diyanatan Arbi me Hadees ke neeche likh di hai ke ye Hadees Mujhe nahi mili kisi bhi hadees ki kitab me jo mere paas maujood hai……. Scan me sab maujood hai.

Shaikhul hadees Rahmatullahi alaih ne fazael e namaz ke Shuru me apna usool bataya hai ke SANAD O RIWAYAT par jo bhi bahes hogi us ko wo ARBI me bayan karenge Tafseel aap Muqadme me padhlen us ka scan hum yahan dedete hain.

To is se ye aetraz khud ba khud rafa hojata hai aur Ghair Muqallideen ka fareb /jahalat saamne aati hai ke wo kis tarah awaam ko dhoka dete hain.

Ab Aayye chand Ghair Muqallideen ke Hadees ke mutalliq fareb kaariyan aur Hadees ki sanad ke sath ched chaad dekhte hain:

(1)Mashhoor Ghair Muqallid Jalal Uddin Qasmi apni kitab Ahsanul JIdaal me  Abu Dawood ki Hadees ka Pehla Hissa Naqal karte hai aur Ibn Maja ka Aakhri ka Hissa naqal karte hai aur Hawale me Dono Hadees ka Naam likhte hain aur Khayanat ka kaam karte hain

Apne Aslaaf Par Aetemad Karna Aur Un Ke Sath Husn E Zann Ka Ma’mla Rakhna Wo Daulat Hai Jis Ke Sadqe Me Aaj Taj Deen Apni Saheeh Shakhl Me Hamare Hathon Me Mehfooz Hai Isi Baat Ko Hazrat Shah Wali Ullah Dehlawi Rahmatullahi alaih Ne Iqd Ul Jeed Me Bayan Farmaya Hai
أَن الْأمة اجْتمعت على أَن يعتمدوا على السّلف فِي معرفَة الشَّرِيعَة فالتابعون اعتمدوا فِي ذَلِك على الصَّحَابَة وَتبع التَّابِعين اعتمدوا على التَّابِعين وَهَكَذَا فِي كل طبقَة اعْتمد الْعلمَاء على من قبلهم وَالْعقل يدل على حسن ذَلِك لِأَن الشَّرِيعَة لَا تعرف إِلَّا بِالنَّقْلِ والإستنباط وَالنَّقْل لَا يَسْتَقِيم إِلَّا بِأَن تَأْخُذ كل طبقَة عَمَّن قبلهَا بالإتصال.

Khateeb Baghdadi Ne “Al Faqeeh Wal Muttafaqqih” Me Ijtehad O Taqleed Ki In Zarooriyaat Ko Badi Wazahat Ke Sath Bayan Kiya Hai Chunancheh Likhte Hain:

وَالْأَحْكَامُ عَلَى ضَرْبَيْنِ عَقْلِيٍّ وَشَرْعِيٍّ، فَأَمَّا الْعَقْلِيُّ: فَلَا يَجُوزُ فِيهِ التَّقْلِيدُ , كَمَعْرِفَةِ الصَّانِعِ تَعَالَى وَصِفَاتِهِ وَمَعْرِفَةِ الرَّسُولِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَصِدْقِهِ , وَغَيْرِ ذَلِكَ مِنَ الْأَحْكَامِ الْعَقْلِيَّةِ وَحُكِيَ عَنْ عُبَيْدِ اللَّهِ بْنِ الْحَسَنِ الْعَنْبَرِيِّ أَنَّهُ قَالَ: يَجُوزُ التَّقْلِيدُ فِي أُصُولِ الدِّينِ وَهَذَا خَطَأٌ لِقَوْلِ اللَّهِ تَعَالَى: {اتَّبِعُوا مَا أُنْزِلَ إِلَيْكُمْ مِنْ رَبِّكُمْ وَلَا تَتَّبِعُوا مِنْ دُونِهِ أَوْلِيَاءَ قَلِيلًا مَا تَذَكَّرُونَ} [الأعراف: 3] وَقَالَ اللَّهُ تَعَالَى: {وَإِذَا قِيلَ لَهُمُ اتَّبِعُوا مَا أَنْزَلَ اللَّهُ قَالُوا بَلْ نَتَّبِعُ مَا أَلْفَيْنَا عَلَيْهِ آبَاءَنَا أَوَلَوْ كَانَ آبَاؤُهُمْ لَا يَعْقِلُونَ شَيْئًا وَلَا يَهْتَدُونَ} [البقرة: 170]……..

وَأَمَّا الْأَحْكَامُ الشَّرْعِيَّةُ , فَضَرْبَانِ: أَحَدُهُمَا: يُعْلَمُ ضَرُورَةً مِنْ دِينِ الرَّسُولِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَالصَّلَوَاتِ الْخَمْسِ , وَالزَّكَوَاتِ , وَصَوْمِ شَهْرِ رَمَضَانَ , وَالْحَجِّ , وَتَحْرِيمِ الزِّنَا وَشُرْبِ الْخَمْرِ , وَمَا أَشْبَهَ ذَلِكَ، فَهَذَا لَا يَجُوزُ التَّقْلِيدُ فِيهِ , لِأَنَّ النَّاسَ كُلَّهُمْ يَشْتَرِكُونَ فِي إِدْرَاكِهِ , وَالْعِلْمِ بِهِ , فَلَا مَعْنَى لِلتَّقْلِيدِ فِيهِ وَضَرْبٌ آخَرُ: لَا يُعْلَمُ إِلَّا بِالنَّظَرِ وَالِاسْتِدْلَالِ: كَفُرُوعِ الْعِبَادَاتِ , وَالْمُعَامَلَاتِ , وَالْفُرُوجِ , وَالْمُنَاكَحَاتِ , وَغَيْرِ ذَلِكَ مِنَ الْأَحْكَامِ , فَهَذَا يُسَوَّغُ فِيهِ التَّقْلِيدُ , بِدَلِيلِ قَوْلِ اللَّهِ تَعَالَى: {فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَ} [النحل: 43] وَ أَمَا مَنْ يَسُوغُ لَهُ التَّقْلِيدُ فَهُوَ الْعَامِّيُّ: الَّذِي لَا يَعْرِفُ طُرُقَ الْأَحْكَامِ الشَّرْعِيَّةِ , فَيَجُوزُ لَهُ أَنْ يُقَلِّدَ عَالِمًا , وَيَعْمَلَ بِقَوْلِهِ , قَالَ اللَّهُ تَعَالَى: {فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَ} [النحل: 43]

عَمْرَو بْنَ قَيْسٍ , يَقُولُ فِي قَوْلِ اللَّهِ تَعَالَى: {فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَ} [النحل: 43] , قَالَ: «أَهْلُ الْعِلْمِ»

 

عَنِ ابْنِ عَبَّاسٍ: أَنَّ رَجُلًا , أَصَابَهُ جُرْحٌ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَعْنِي: فَاحْتَلَمَ فَأُمِرَ بِالِاغْتِسَالِ , فَاغْتَسَلَ فَمَاتَ , فَبَلَغَ ذَلِكَ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ , فَقَالَ: «قَتَلُوهُ قَتَلَهُمُ اللَّهُ , إِنَّ شِفَاءَ الْعِيِّ السُّؤَالُ» الخ

وَلِأَنَّهُ لَيْسَ مِنْ أَهْلِ الِاجْتِهَادِ فَكَانَ فَرْضُهُ التَّقْلِيدَ , كَتَقْلِيدِ الْأَعْمَى فِي الْقِبْلَةِ , فَإِنَّهُ لَمَّا لَمْ يَكُنْ مَعَهُ آلَةُ الِاجْتِهَادِ فِي الْقِبْلَةِ , كَانَ عَلَيْهِ تَقْلِيدُ الْبَصِيرِ فِيهَا

Aqli Ahkaam Me Taqleed Jayaz Nahi Hai Jaise Saane’ Aalam Aur Uski Sifaat Ki Marifat,  Is Tarah Rasoolullah Sallallahu Alaihi Wasallam Aur Aap Ke Sache Hone Ki Marifat Waghairah Ubaidullah Hasan Ambari Se Manqool Hai Keh Wo Usool E Deen Me Bhi Taqleed Ko Jayaz Kehte The. Lekin Ye Ghalat Hai Is Liye Keh Allah Ta’ala Farmate Hain “Tumhare Rab Ki Janib Se Jo Wahii Aayi Usi Par Amal Karo Us Ke Ilawah Doosre Auliaa Ki Itteba’ Na Karo Kis Qadr Kam Tum Log Naseehat Hasil Karte Ho” Isi Tarah Allah Ta’ala Farmate Hain “Jab Un Logon Se Kaha Jata Hai Keh Allah Ki Utaari Hui Kitab Ki Itteba Karo To Woh Log Kehte Hain: Nahi Hum Us Cheez Ki Itteba Karenge Jis Par Hum Ne Apne  Baap O Dada Ko Paya Hai Chahe Un Ke Baap O Dada Be Aqal Aur Be Hidayat Hon.”

Doosri Qism Ahkaam E Shar’iyah , Aur Unki 2 Qismen Hain.

(1) Deen Ke Wo Ahkaam Jo Wazahat O Sarahat Ke Sath Maloom Hon. Jaise Roza ,Namaz, Haj , Zakat Isi Tarah Zina Aur Sharab Ka Haram Hona Waghaira To In Me Taqleed Jayaz Nahi hai, Kyun Keh In Ke Jaanne Me Saare Log Barabar Hain Is Liye In Me Taqleed Ka Koi Ma’ina Nahi.

(2) Deen Ke Wo Ahkaam Jin Ko Nazar O Istedlal Ke Baghair Nahi Jana Jasakta Jaise Ibadaat, Ma’mlaat, Nikah Waghairah Ke Firoi Masael To In Me Taqleed Karni Hai Allah Ta’ala Ke Qaul فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لَا تَعْلَمُونَKi Daleel Se. Aur Wo Log Jin Ko Taqleed Karni Hai woh Hazraat Hain Jin Ko Ahkaam E Shar’iyah Ke Istimbaat Ke Tareeqe  Maloom Nahi Hain To Un Ke Liye Kisi Aalim Ki Taqleed Aur Us Ke Qaul Par Amal Kiye Baghair Chaarah Nahi Hai. Allah Ta’la Ka Irshad Hai Ahle Ilm Se Maloom Karo Agar Tum Ko Maloom Nahi…………..

Ibne Abbas Razi Allahu  Anhu Se Marwi Hai Keh Ek Aadmi Huzoor Sallallahu Alaihi Wasallam Ke Daur E Mubarak Me Zakhmi Hogaye Phir Unhe Ghusl Ki Hajat Hogayi Logon Ne Unhe Ghusl Karne Ka Hukm De Diya Jis Ki Wajeh Se Un Ki Maut Hogayi, Is Ki Ittela Nabi Kareem Sallallahu Alaihi Wasallam Ko Hui To Aap Sallallahu Alaihi Wasallam Ne Farmaya Khuda Un Ko Barbaad Kare Un Logon Ne To Us Bechare Ko Qatl Kardiya. Aajiz Reh Jaane Wale Ki Kamiyabi Sawal Kar Lene Hi Me Hai.

Doosri Is Ki Daleel Ye Hai Ke Ye Shakhs Ahl E Ijtehad Me Se Nahi Hai To Us Par Taqleed Hi Farz Hai. Jaise Andha Jab Us Ke Paas Zarye Ilm Nahi Hai To Qibleh Ke Silsile Me Us Ko Kisi Dekhne Wale Ki Baat Maanni Hogi.

Taqleed Ka Wujoob Aur Uski Zaroorat

Is Amr Se Kisi Musalman Ko Ikhtelaf Nahi Hosakta Keh Deen O Shariayt Ki Hifazat Intehai Zaroori Aur Wajib Hai. Kyun Keh Deen Ki Hifazat Ke Baghair Insaan Na To Deen Par Chal Sakta Hai Aur Na Hi Un Kamiyabiyon Ko Hasil Karsakta Hai Jin Ki Taraf Deen Le Jata Hai. Yahi Wajeh Hai Keh Quran O Hadees Me Baar Baar Deen Aur Umoor E Deen Ki Hifazat Ki Takeed O Talqeen Ayi Hai. Deen Ke Wo Ma’amlaat Jin Ka Sarahat Aur Wazahat Ke Sath Kitab O Sunnat Me Hukm Aya Hai Unko Wajib Biz Zaat Kehte Hain. Isi Tarah Baaz Wo Wajibaat Hote Hain Keh Kitab O Sunnat Se Wajib Qarar Diye Hue Aamal Par Amal Karna Un Ke Baghair Mumkin Nahi Hosakta. Chunkeh Wo Wajib Ki Adaigi Ka Muqaddamah Aur Zarya Bante Hai Aur Ye Shar’ii Zaabtah Hai Keh Wajib Ka Muqaddamah Bhi Wajib Hota Hai Aur Ye Zabtah Muslim Shareef  Ki Is Hadees Se Bhi Sabit Hota Hai.

عَن عُقْبَةَ بْنِ عَامِرٍقَالَ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم  يقولُ: «مَنْ علِمَ الرَّميَ ثمَّ تَرَكَهُ فَلَيْسَ مِنَّا أَوْ قَدْ عَصَى» . رَوَاهُ مُسلم (مشکوۃ المصابیح)

Shariyat Me Is Ki Bhot Si Misalen Hain Maslan Quran E Kareem Aur Ahadees E Shareefah Ko Jama Kar Ke Likhne Ki Kitab O Sunnat Me Kahin Bhi Takeed Nahi Aayi Hai Lekin Inke Mehfooz Rakhne Zaa’ye Hone Se Bachane Ki Zabardast Takeed Aayi Hai Aur Tajurbe Aur Mushahadeh Se Maloom Hai Kitabat Ke Baghair In Ka Mehfooz Rehna Aadatan Mumkin Nahi , Is Liye Quran O Hadees Ki Kitabat Ko Zaroori Samjha Jayega Chunacheh Is Ke Wajib Aur Zaroori Hone Par Poori Ummat Ka Dalalatan Ijmaa Hai Is Qism Ke Wajib Ko Wajib Bilghair Kehte Hain.

Taqleed E Shakhsi Ka Wajib Hona Bhi Isi Qubail Se Hai Kyun Keh Deen Ki Hifazat Jo Har Musalman Par Farz O Wajib Hai Wo Khairul Quroon Ke Baad Taqleed E Shakhsi Ke Bagahir Mumkin Nahi Hai , Taqleed Na Karne Se Deen Ke Beshumaar Umoor Balkeh Poore Deen Me Zabardast Khalal Waqe’ Hota Hai Is Haqeeqat Ko Wazahat Ke Sath Yun Samjhye Keh Masael E Fir’Iyyah Do Qism Ke Hote Hain

Aise Masael Ko Mansoosah Ghair Muta’arizah Kehte Hain Is Tarah Ke Masael Me Kisi Bhi Mujtahid Ke Liye Ijtehad Karna Jayaz Nahi Kyun Keh Ijtehad Ki Sharait Me Se Hai Keh Wo Hukm Sarahatan Sabit Na Ho Aur Jab In Masael Me Ijtehad Nahi To In Masael Me Kisi Ki Taqleed Bhi Nahi Hai.

(2) Doosri Qism Un Masael Ki Hai, Jin Ka Saboot Wazahat Ke Sath Kisi Aayat Aur Hadees Me Nahi Milta. Ya Agar Saboot Paya Jata Hai To Wo Ayat Aur Hadees Aur Bhi Ma’aani Aur Wujooh Ka Ahtemal Rakhti Hai. Ya Kisi Doosri Aayat Ya Hadees Se Bazaahir Muta’aariz Maloom Hoti Hai. Aise Masael Ko Masael E Ijtehadiyah Kehte Hain Aur In Ka Saheeh Hukm Mujtahid Ke Ijtehad Hi Se Maloom Ho Sakta Hai. Woh Shakhs Jo Apne Andar Ijtehad Ki Quwwat Nahi Rakhta, Agar In Masael Me Raaye Zani Karne Lage To Nafsani Khwahishaat Ke Phandon Me Ulajh Kar Reh Jayega. Is Liye Zaroori Hua Keh Ummat Ke Baaz Afraad Ko Aisi Quwwat E Istimbaat O Ijtehad Ataa Ki Jaye Jis Ke Zarye Wo Nusoos Kitab O Sunnat Me Ghaur O Fikr Kar Ke Masael E Ghair Mansoosah Ke Ahkaam Hasil Kar Ke Aam Ummat Ke Samne Pesh Karde Taakeh Un Ke Liye Deen Par Amal Ka Rasta Be Khatr Aur Aasan Hojaye, Sahaba Rizwanullahi Alaihim Ajma’een Me Se Wo Hazraat Jo Hama Waqt Darbar E Nabawi Ke Haazir Baash The Unhe Is Quwwat E Ijtehad Se Kaam Leni Ki Zaroorat Nahi Thi Kyun Keh Un Ke Liye Janab Rasoolullah Sallallahu Alaihi Wasallam Ki Zaat E Girami Hi Har Mas’leh Ka Hal Aur Har Sawal Ka Kaafi O Shaafi Jawab Thi.

Janab Rasoolullah Sallallahu Alaihi Wasallam Ne Hazrat Muaz Bin Jab Razi Allahu Anhu Ko Yemen Bhejte Hue Saaf Lafzon Me Nemat E Ijtehad Ki Taayeed O Tehseen Aur Us Par Apni Masarrat Ka Izhar Farmaya Abu Dawood Shareef Ki Riwayat Me Hai

عَنْ مُعَاذِ بْنِ جَبَلٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا بَعَثَهُ إِلَى الْيَمين قَالَ: «كَيْفَ تَقْضِي إِذَا عَرَضَ لَكَ قَضَاءٌ؟» قَالَ: أَقْضِي بِكِتَابِ اللَّهِ قَالَ: «فَإِنْ لَمْ تَجِدْ فِي كِتَابِ اللَّهِ؟» قَالَ: فَبِسُنَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «فَإِنْ لَمْ تَجِدْ فِي سُنَّةِ رَسُولِ اللَّهِ؟» قَالَ: أَجْتَهِدُ رَأْيِي وَلَا آلُو قَالَ: فَضَرَبَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى صَدْرِهِ وَقَالَ: «الْحَمْدُ لِلَّهِ الَّذِي وَفَّقَ رَسُولَ رَسُولِ اللَّهِ لِمَا يَرْضَى بِهِ رَسُولُ اللَّهِ» . رَوَاهُ التِّرْمِذِيّ وَأَبُو دَاوُد

“Jab Koi Qizya Pesh Aaye To Kis Tarah Faisla Karoge, Arz Kiya Kitabullah Ke Mutabiq Faisla Karunga, Apne Farmaya “Agar Wo Masla Kitabullah Me Na Mile To?” Arz Kiya “Rasoolullah Sallallahu Alaihi Wasallam Ki Sunnat Ke Mutabiq Faisla Karunga.” Ap Sallallahu Alaihi Wasallam Ne Farmaya “Agar Kitabullah Aur Sunnat E Rasoolullah Sallallahu Alaihi Wasallam Dono Me Na Mile To? Arz Kiya “Us Waqt Apni Raaye Se Faisla Karunga Aur (Haq Tak Pohanchne Ki Koshish Me) Koi Kotahi Nahi Karunga” Is Par Aanhazrat Sallallahu Alaihi Wasallam Ne Hazrat Muaz Razi Allahu Anhu Ke Seene Par Hath Maara Aur Farmaya Allah Ka Shukr Hai Keh Us Ne Apne Rasool Ke Qaasid Ko Is Baat Ki Taufeeq Di Jis Se Allah Ka Rasool Raazi Hai.”

«إِنَّ اللَّهَ لاَ يَنْزِعُ العِلْمَ بَعْدَ أَنْ أَعْطَاكُمُوهُ انْتِزَاعًا، وَلَكِنْ يَنْتَزِعُهُ مِنْهُمْ مَعَ قَبْضِ العُلَمَاءِ بِعِلْمِهِمْ، فَيَبْقَى نَاسٌ جُهَّالٌ، يُسْتَفْتَوْنَ فَيُفْتُونَ بِرَأْيِهِمْ، فَيُضِلُّونَ وَيَضِلُّونَ»
